ذكرت صحيفة صاندي تايمز ان المحكمة العليا في دبلن ، جمهورية ايرلندا ، ستنظر في غضون الايام الثمانية القادمة في الدعوى المرفوعة ضد محرك البحث غوغل ،بصفته المالك ليوتوب ، في قضية تشهير مست رجل الاعمال الجزائري علاب الخير من طرف المدعو هشام عبود .
وقد اوكل السيد علاب الى المحامي العالمي بول تويد اقامة هذه الدعوى نظرا لعدم قيام ادارة غوغل بسحب مجموعة من فيديوهات القذف والتشهير في حق المعني رغم تلقيها مراسلات في الموضوع وتبليغها بمنطوق احكام قضائية صدرت عن القضاء السويسري ،والتي ننشر نسخا عنها ، تدين المدعو عبود ومنها على وجه الخصوص حكم نهائي صدر في جوان الماضي .
وصرح المحامي بول تويد ان غوغل سحب عددا من الفيديوهات من يوتوب لكن بعض الفيديوهات التي تضمنت قدحا وتشهيرا لا تزال على يوتوب وهو ما حتم رفع قضية ضد غوغل ايرلندا ..
وقد تضمن الاستدعاء الموجه لغوغل امرا بالحضور او عن طريق محامي الى المكتب المركزي للمحكمة في دبلن في غضون ثمانية ايام من تاريخ استلام الاستدعاء .
يذكر ان رجل الاعمال الجزائري رفع دعوى قضائية امام القضاء السويسري ضد هشام عبود وقناته بعد بث مجموعة من الفيديوهات التي تضمنت قدحا وتجريحا .
وقد اخذت القضية مسارها الإجرائي واصدر القضاء السويسري في جوان الماضي حكم ادانة نهائي ضد عبود هشام وتغريمه ب 485000 فرنكا سويسريا.
ويجري اتخاذ اللازم من اجل تنفيذ هذا الحكم خارج نطاق القضاء السويسري ليشمل القضاء الاوروبي .
هل يوجه الحركي المدعو هشام عبود القضاء السويسري والاوروبي عامة ام يهرب مثلما يفعل دائما عندما يشعر بالخطر الى حضن المخزن المغربي الذي يوفر له الأمان في اوروبا و خارج اوروبا ويصرف عليه نتيجة العمالة والخيانة الظاهرة ضد وطنه الجزائر.

An Algerian businessman who is pursuing a defamation case against Google Ireland over videos posted about him on YouTube went through the courts in Switzerland and France before initiating legal proceedings in Dublin last week. However, Paul Tweed, his lawyer, has insisted this is not a case of “libel tourism”.
Kheir Allab, who has a French passport and lives in France, Switzerland and Algeria, has taken out successful cases against Hichem Aboud, the operator of YouTube channels Hichem Aboud and Amel TV. He claims that 12 videos, published between March and September 2020, are defamatory of him.
In the Swiss case, which began in May last year, the court found in favour of Allab and ordered the removal of the videos and prohibited publication of further videos. However, Allab alleged that the videos were not removed. This year he initiated criminal libel proceedings in France against Aboud, with the court ruling in his favour. Aboud was required to pay €2,000 damages and €2,000 fees.
Allab, who ran a modelling agency before becoming involved in the electronics industry in Algeria, did not initially take out a case against Google but Tweed, who specialises in cases against social media companies and publishers, initiated proceedings last week. The lawyer said his client was forced to pursue the case against Google because it had not taken down the YouTube videos or suspended Aboud’s accounts.
“This is not libel tourism. Kheir Allab has gone through the courts in Switzerland where the first YouTube channel was based,” Tweed said. “He initiated a case against the individual and the Swiss courts were satisfied that it was defamation. He then went through the French courts because that’s where we believed the individual lived.
“We now must go through the Irish courts because Google Ireland is the headquarters for Google’s European Middle Eastern and Africa (Emea) operations.”
In the Irish case Allab is seeking damages for defamation, damages for an alleged breach of the Data Protection Act 2018, and orders to take down the videos on YouTube.
The case is the latest taken up against a social media group with area headquarters in Ireland. In 2016, Ismail Omar Guelleh, president of the east African country Djibouti, took up a case against Facebook in Dublin. Last year Ghanem Nuseibeh, a London consultant, filed a High Court action against WhatsApp over claims his account was hacked.
